1. Legal Identification

In accordance with Article 10 of Spain's Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), the following information is provided about the operator of this service:

By creating an account and ticking the acceptance checkbox during onboarding, you confirm that:

• →You are at least 18 years old (or the legal age of majority in your country, if higher).
• →You have read and understood these Terms of Service and our Privacy Policy.
• →You agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the service.

3. What Bilbao GEMS Is

Bilbao GEMS is a personally curated city guide for Bilbao, delivered as a Progressive Web App (PWA) — accessible from any mobile browser, no download required. It provides:

• →An interactive map of curated points of interest (places) in and around Bilbao, filtered by category.
• →Detailed place pages with editorial descriptions, practical tips, timing advice, and directions.
• →Compass Mode: a real-time navigation tool that points your device toward a selected place and shows walking distance.
• →Live Nudges: timely editorial tips about events, rituals, and moments happening in the city right now.

This is an editorial service. All content reflects the curator's personal experience and judgement. Bilbao GEMS is not a listing platform — places are selected, not submitted.

4. User Accounts

To access the full app, you must create a free account. By doing so, you agree that:

• →You provide a valid, real email address — not a disposable or fake address.
• →You are responsible for keeping your account secure. Do not share your magic links with others.
• →One account per person. Creating multiple accounts or sharing an account is not permitted.
• →You will not create an account on behalf of another person or using false information.

During the pilot phase, accounts are free. Creating an account does not automatically commit you to any future paid subscription.

5. Permitted and Prohibited Use

What you may do

You may use Bilbao GEMS for your own personal, non-commercial use as a visitor to or resident of Bilbao. You may share individual place recommendations with friends and family.

What you may not do

• →Scrape, copy, extract, or systematically download any content from the app — including place descriptions, tips, the curated list itself, or images.
• →Use the service for commercial purposes (e.g. to build a competing guide, resell access, or monetise the curated content) without our written permission.
• →Attempt to reverse-engineer, decompile, or tamper with the app.
• →Use automated tools, bots, or scripts to access the service.
• →Attempt to gain unauthorised access to another user's account or to our systems.
• →Upload, transmit, or cause the display of any content that is unlawful, harmful, abusive, or infringes on any third-party rights.

6. Intellectual Property

All editorial content in Bilbao GEMS — including the selection and curation of places, written descriptions, practical tips, the editorial voice, the app design, and any original photography — is the intellectual property of Bilbao GEMS. You may not reproduce, distribute, adapt, or create derivative works from this content without our prior written permission.

Place names, street addresses, and general geographic information are factual and are not protected by copyright. Third-party images (e.g. uploaded by place owners, sourced from external providers) remain the intellectual property of their respective owners.

Nothing in these Terms grants you any licence to the Bilbao GEMS brand, name, or logo.

7. Our Editorial Pledge

We make the following irrevocable commitments to every user of Bilbao GEMS:

These are foundational commitments, not features that can be switched off. We will not compromise them.

8. Pricing and Payment

Pilot phase (current)

Bilbao GEMS is currently free during our pilot launch. No credit card is required to create an account, and no payment will be taken without advance notice and your explicit consent.

Future pricing

After the pilot phase, we may introduce a subscription fee — currently planned at €3 per month. Before this happens:

• →We will give you at least 30 days' advance notice by email.
• →You will be able to choose whether to continue with a paid subscription or close your account.
• →If you choose not to subscribe, your account will remain accessible until the transition date and will then be deactivated — not deleted, unless you request deletion.

No automatic billing

We will never charge you without a clear, separate, affirmative agreement. Creating a free account during the pilot does not constitute any agreement to future charges.

9. Service Availability

Bilbao GEMS is provided on a best-effort basis during the pilot phase. We do not provide any uptime guarantee. You acknowledge that:

• →The service may be temporarily unavailable for maintenance, updates, or reasons beyond our control.
• →Third-party services (Mapbox, Supabase, Vercel, Cloudinary, Google) have their own availability and maintenance schedules that may affect the app.
• →We may modify, update, or remove features of the app at any time, with reasonable notice where the change is material.

10. Accuracy of Information

We make every reasonable effort to ensure that information about places in the app is accurate and current. However, you acknowledge that:

• →Opening hours, menus, prices, and services at any place can change without notice. We cannot guarantee accuracy at the time of your visit.
• →Places may close, relocate, or change ownership. We update the guide regularly, but cannot do so in real time.
• →We are not responsible for any inconvenience, cost, disappointment, or loss arising from relying on information in the app.
• →Links to Google Maps are provided for navigation convenience only. We are not affiliated with Google and are not responsible for the accuracy of Google Maps data.

11. Limitation of Liability

To the maximum extent permitted by applicable Spanish law:

• →Bilbao GEMS is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service.
• →Our total cumulative liability for any claim arising from or related to this service is limited to the amount you have paid us in the 12 months preceding the claim — which, during the free pilot phase, is €0.
• →We are not liable for the acts or omissions of third-party services (Mapbox, Google Maps, Supabase, etc.).

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under Spanish or EU law.

12. Account Termination

By you

You may request deletion of your account at any time by emailing bilbaogems@gmail.com with the subject line “Delete my account”. We will permanently delete your account and all associated personal data within 30 days.

By us

We may suspend or permanently terminate your account, with or without notice, if you:

• →Violate any provision of these Terms of Service.
• →Engage in abusive, fraudulent, or unlawful behaviour.
• →Attempt to misuse, harm, or gain unauthorised access to the service.
• →Create accounts fraudulently or circumvent access controls.

Where possible, we will give notice and an opportunity to remedy a violation before terminating an account. Immediate suspension may occur where security requires it.

13. Governing Law and Disputes

These Terms of Service are governed by and construed in accordance with the laws of Spain. Any dispute arising from or in connection with these Terms or your use of Bilbao GEMS shall be submitted to the exclusive jurisdiction of the courts of Bizkaia (Bilbao), Spain.

If you are a consumer resident in the European Union, you also have the right to use the EU Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr

Nothing in this clause affects your statutory rights as a consumer under Spanish or EU consumer protection law.

14. Changes to These Terms

We may update these Terms of Service at any time. For material changes — those that affect your rights, obligations, or pricing — we will:

• →Notify you at least 30 days before the changes take effect (by email if you have opted in to notifications, or by a prominent notice in the app).
• →Update the "Effective" date at the top of this page.
• →Give you the option to close your account if you do not accept the new terms.

Your continued use of Bilbao GEMS after the effective date of any changes constitutes acceptance of the updated Terms.
